The Renter states that he/she is physically and legally qualified to operate the above-described vehicle. The vehicle may be driven during the term of hire only, by the person/s named on this Rental Agreement. The renter needs to hold a current valid driving licence when riding the vehicle. All fuel used shall be paid for by the renter. The rental along with security deposit will be paid in advance only. Until we receive this your rental is not confirmed. There are no refunds for the early returns of bike. Minimum hire period is 4 weeks.
The renter acknowledges that he/she will be liable to pay any charges, those include:
1.1. Charges for late return and late service of the vehicle.
1.2. Traffic and/or parking fines, includes Penalty Charge Notice.
SK MOTORS LTD will not accept any liability for charges occurred on the vehicle, in the time of hire and the renter shall pay all fees directly to the appropriate authority.
1.3. The rented vehicle shall not be used to carry other passengers or property for hire other than the renter and one back rider with appropriate safety helmet, provided only if he/she has full motorcycle license.
The rented vehicle shall not be used to push, propel, or tow another vehicle, or any other thing without the written consent of the owner.
The rented vehicle shall not be used for any race or in any competition or allow it to be operated in any race, speed test, reliability trial, rally, contest, or operated on any race or rally circuit or in any event as testing in preparation for any of them.
The rented vehicle shall not be used for any illegal purpose or allow it to be operated in breach of law.
The renter is not allowed to sublet or hire the vehicle to any other person.
The renter will not operate the vehicle or allow it to be operated in any circumstances that constitute an offence.
The renter will not drive or allow the vehicle to be driven by any person if at the time of driving the vehicle the driver does not hold a current full valid driving licence appropriate for vehicle.
In accordance with the Road Traffic offenders Act 1988 the hirer shall be liable as the owner of the vehicle in respect of: –
All reasonable care is taken when driving and parking the vehicle:
9.1. The engine oil in the vehicle is maintained at the proper quantity level and quality.
9.2. Only the fuel type specified for the vehicle should be used.
9.3. The tires are maintained at their appropriate tyre pressure.
9.4. The vehicle should be locked and always secured, and when not in use the keys should be kept under the hirer’s personal control and safe all the time.
9.5. Should a warning light be illuminated, or the renter believes the vehicle requires mechanical attention; the renter will stop driving and inform the owner immediately.
Any excess charge which may be incurred in pursuance of an order under Section 45 and 46 of the Road Traffic Regulation Act 1984(provision on Highways of Parking places where charges are made).
If the vehicle is involved in an accident, damaged, breaks down, requires repair or salvage, regardless of the cause, the renter should be notifying the owner of all circumstances by telephone immediately as soon as possible.
If the vehicle requires repair or replacement, the decision to supply another vehicle to the renter is at the discretion of SK MOTORS LTD by the renter. If the owner receives notice of any traffic or parking offenses, incurred by the renter. The company will notify the renter of any such notice as soon as practically possible and provide the necessary information to the relevant issuing authority. For the liability to be redirected to the renter. The Renter has the right to challenge, complain, query or object to the alleged offense to the issuing enforcement authority and has a right to seek a court hearing, if he/she deemed necessary.
After any kind of collision rider must keep the proof of the incident regardless of whose party’s fault it is, which includes photos and or video of other driver, car model, registration plate and telephone numbers of the witnesses and person involved in the collision.
If the biker is at fault in a specific accident than he will be liable to pay excess fee in full. In the case of Bike fire, theft, or any major damage same excess fee of £2000.00 will be applied.
There will be paid recovery always provided, if needed.
The renter should deliver the vehicle to the company address, or to a different address with the consent from the company owner, before the expiry of the term of hire. The renter may obtain owner’s consent for the extension of the rental hire agreement (in which case the renter shall pay additional hire charges for the extended term of hire).
If the renter does not return the vehicle, the owner may report the vehicle as stolen to the Police and the renter must compensate the owner for either the full cost of vehicle or all additional costs and losses incurred up to the time that the vehicle is recovered by the owner.
The Renter will be responsible for all penalties related to traffic and/or parking offenses incurred in the term of the hire. The company may charge the hirer’s credit card, debit card, or cash for any traffic and/or parking offense infringement fees incurred by the renter. If the owner receives notice of any traffic or parking offenses, incurred by the renter. The company will notify the renter of any such notice as soon as practically possible and provide the necessary information to the relevant issuing authority. The owner has a right to terminate the hire and take immediate possession of the vehicle, if the renter fails to comply with any of the terms of the Rental Agreement, or if the vehicle is damaged.
If the owner wants to terminate the rental agreement than the renter must be notified by the owner 14 days before to take the possession of the vehicle.
Hire termination request can be made from the renter. If the renter wants to return the hire vehicle than renter must give 14 days advance notice to the owner that means hire vehicle will return after 14 days. Renter notice period will start from when he/she will serve return notice.
The termination the hire under the authority of this clause shall be without prejudice to the other rights of the owner and the rights of the Renter under the Rental Agreement or otherwise.
The parties choose the addresses provided in the contract, as their addresses at which legal proceedings may be instituted.
